JORDANS SUCCEEDS IN SOCIAL SERVICES ABUSE CLAIM

COURT RULES BISHOPS ARE DIRECTLY LIABLE FOR ABUSE OF PRIESTS

This is a case I commented on in my blog on vicarious liability in July. It is a groundbreaking decision and destroys the myth which the Catholic church has tried to peddle that priests are in some way above the law and their Bishops are not responsible for them.
 
The decision was a High Court decision and is likely to be appealed by the church. I only hope it will be heard in July next year alongside the St William’s case I have been pursuing in the Supreme Court.

CALL TO THE INTERNATIONAL CRIMINAL COURT TO INDICT THE POPE 18.03.11.

Since around 2002 there has been a realisation in Europe that Catholic preists have been responsible for a huge amount of sexual abuse of children. The visit to the UK of the Pope in September 2011 prompted a new look into what the vatican has been doing over the years to manage their priests. What I and others who have researched the subject have discovered is that the constitution of the Catholic Church insists on complete secrecy to the extent that those “in the faith” are forbidden to alert the police or to tell lawyers. 

This state of affairs has undoubtedly led to hundreds if not thousands of paedophile priests escaping justice in the courts. Geoffrey Robertson QC has written a book called “The case of the Pope” which explores the Pope’s responsibility for actions of the Catholic church. 

A lawyer in Germany has asked the International Criminal Court in The Hague to indict Dr Ratzinger and I attach his request below.  I have written to the ICC in support of the request with details of cover ups and abuse which I have uncovered in the UK. I sincerely hope for the sake of future generations of children that the church will agree to pass allegations of abuse to the police and will allow the inspection of their secret files on abusing priests and will compensate victims throughout the world.

ST WILLIAMS CHILDRENS HOME  

MARKET WEIGHTON EAST YORKSHIRE  

The Supreme Court has allowed permission for the Roman Catholic Diocese of Middlesbrough to appeal from it’s unsuccessful bid in the Court of Appeal to blame another Catholic organisation for child abuse at the St William’s Childrens Home. The Supreme Court is the last avenue of appeal open to this Catholic Diocese. 

The Court of Appeal had decided on the 26 October 2010 that the Roman Catholic Diocese of Middlesbrough was responsible for compensating victims of child abuse at the St Williams Childrens Home, Market Weighton, East Yorkshire between 1960 and 1992. 

At the time I said : 

“I act on behalf of 158 victims of abuse in this case. The Supreme Court obviously feels this case is of major importance. The Catholic Church has for years tried to escape liability for it’s priests and members and I hope this case will decide the issues once and for all.  

I am anxious to achieve justice for the victims of abuse at St William’s as quickly as possible and the Supreme Court appeal will cause 6-12 months of delay. Despite this I am undeterred by the appeal. I am certain that either the Diocese of Middlesbrough or the De La Salle institute are responsible for compensating victims.” 

In December 2003 James Redmond Carragher, the former Principal of St Williams Childrens Home was found guilty of 7 counts of buggery and 14 counts of indecent assault against 22 boys, some as young as 12. He was sentenced to 14 years imprisonment.  He had earlier served a seven year sentence imposed in 1993 for indecent assaults, taking photographs of young boys and importing videos of mainly children between 1985 and 1992.   

Compensation proceedings on behalf of 158 Claimants were started in 2004. Although two Roman Catholic Organisations were involved in running the St Williams Childrens Home, both organisations have attempted to use legal technicalities to escape responsibility, a tactic mirrored in other Catholic child abuse cases. 

Humberside Police are currently pursuing a further detailed inquiry into sexual abuse of children at St Williams. 

ST WILLIAM’S UPDATE 02.12.10.

YORKSHIRE POST NEWS ARTICLE 09.12.10 

The Court of Appeal have decided on 26th October 2010 that the Diocese of Middlesbrough alone was  the responsible organisation controlling staff at St Williams. 

The Diocese has been refused permission to appeal from the Court of Appeal to the Supreme court. They have now lodged a new attempt to appeal with the Supreme court. They are asking the Supreme court direct for permission to have the case heard there. 

There is good news however as the Diocese now accepts that it will not appeal against the decision that it is responsible for the whole time that St Williams was open. It simply wants to off load some of the responsibility onto the other Catholic organisation mentioned in the case, the De La Salle organisation. 

A decision of the Supreme court is expected in January.

The Newcastle evening chronicle newspaper reports the death of a former prison officer who was a prolific paedophile and preyed on youths at the Medomsley detention centre in County Durham. Many of his victims feel this means he will no longer be a risk to children. Read more
