Divorce for married couples (pack) £275

This pack includes all the documents you usually need from beginning to end of divorce proceedings.

It can also be used for a judicial separation where you want to formally separate but not divorce.

You will need to complete the documents as follows:

A. Issuing Proceedings for Divorce

  1. You need to complete the Petition
  2. If you have children under 18 and in fulltime education you need to complete a Statement of Arrangements
  3. You send the completed forms together with 2 copies of each form to your local County Court with the court fee.
  4. The court will send a copy of the forms to your spouse (the Respondent).  He or she is also sent a form called an acknowledgment of service which he or she must complete and return to the court.
  5. The court will send you a sealed copy of the acknowledgment of service (usually within 28 days unless your spouse delays or does not return it)

B. Applying for Decree Nisi

Complete the application for Decree Nisi form

  1. Complete the appropriate affidavit
  2. Take BOTH documents either to your local County Court or to a solicitors to swear an oath or affirm the contents of the affidavit
  3. Send both documents to the court.

A Judge will check the papers and if satisfied with them set a date for pronouncement of Decree.  You will receive notification from the court of the date on which Decree will be pronounced.

C. Applying for Decree Absolute in Divorce proceedings

A minimum of 6 weeks and one day after Decree Nisi is pronounced you may apply for a Decree Absolute.  Complete the application for the Decree Absolute to be made final and send it together with 2 copies and the appropriate fee to the court.
