If you are planning to marry or register a civil partnership you can enter into an agreement to state what will happen to your assets and income in the event that your marriage or civil partnership ends.

Although Pre-Nuptial/Pre-Civil Partnership Agreements are not automatically legally enforceable they do carry weight following a Supreme Court Judgment in 2010 (Radmacher –v- Cranationo).  That Judgment says that courts should give effect to such agreements when deciding on financial settlements provided certain criteria are met.  The court must be satisfied that BOTH of you have:

Fully understood the meaning and implications of the agreement

  1. Have offered the other full disclosure of all relevant information and documents
  2. Intended the agreement to regulate financial matters between you on Decree/Dissolution
  3. Entered into the agreement voluntarily and without undue pressure
  4. The Agreement would be fair having regard to both your circumstances at the time of the Decree/Dissolution.

Each of you is advised to take separate independent legal advice before signing the agreement.
