Court Rules can be very daunting. With the changes in the small claims’ limit increasing to £10,000 many businesses handle their own claims. The changes in the rules encourage this.
Court Rules are complicated. Just because you handle your own case doesn’t mean the rules don’t apply to you. All civil cases must follow the Civil Procedure Rules. There is a whole book the size of War and Peace containing these rules.
If you are not a lawyer how are you supposed to know?
If you do not follow the court rules to the letter your case could be damaged. Typical problems include:
- There might be a claim or a defence you could raise which you didn’t know about. The Judge can’t consider this for you.
- A good claim or defence will not win without the right evidence.
- If you miss a deadline your case might not be heard by the Judge.
That doesn’t seem fair to us.
