The High Court has approved an award of compensation to a Claimant whose husband, Mr Finlay, died after the NHS failed to act upon the results of tests which showed traces of cancer in his appendix in 2008.

It was not until 2011, when Mr Finlay returned to the hospital after experiencing significant back pain that further tests were performed which showed that the cancer had spread from the abdomen to his spine. Sadly, Mr Finlay died shortly afterwards, in February 2012.

The Trust admitted to there being ‘system failures’ which led to the delay in the diagnosis of the cancer.

The exact sum of compensation award to Mrs Finlay has been kept confidential.
