You can make a valid Will without the use of a Solicitor, and many people like to do so to avoid the cost of legal advice. However, the cost of making a Will with a Solicitor may be less than you might expect, and this advice could save your family and loved ones much more money in the long run.

A recent case (Payne v Payne, 2018 EWCA Civ 985) has highlighted the problems caused by homemade Wills which were not properly executed. Mr Payne left most of his estate to his son from his first marriage by his 2012 homemade Will. His previous 1998 homemade Will left his entire estate to his second wife. The Central London County Court found that both Wills were invalid due to problems with their execution. At appeal, the 2012 Will remained invalid, but the 1998 Will was declared valid, on the basis that the witnesses had provided sufficient evidence to demonstrate that the Will was correctly executed.

The result is that the estate passed to his second wife, and not his son from his first marriage as may have been his intention. Furthermore, the cost of taking this recent case all the way to appeal could have been avoided if the 2012 Will was correctly executed.
