What does TUPE do?
As a busy employer you might be unaware that the Transfer of Undertakings (Protection of Employment) Regulations 1981 (or “TUPE” for short) introduced 3 important concepts: (1) the automatic transfer principle under which employees transfer with the new employer inheriting key rights, liabilities and obligations; (2) protection against dismissal in connection with a TUPE transfer; and (3) the obligation to inform and consult. Following a transfer many employers seek to make changes on the basis of an economic, technical or organisational reason (known as an “ETO reason”) often meeting resistance from employees who do not like change.
