Case Study – Claim against Birmingham City Council

Jordans Solicitors acted for the Claimant who alleged that in 1977 when she was aged 14 years old and residing in a children’s home she was sexually assaulted by an employee of the Defendant working at the home. The police contacted the Claimant in 2004, charges were brought against the perpetrator, and he was convicted of rape against the Claimant.
The Defendant defended this claim on the issue of limitation. They alleged that there was no good reason for the Claimant’s delay, they lost the opportunity to investigate the claim, and the perpetrator is now deceased. Limitation expired in 1984.
The Defendant confirmed prior to the death of the perpetrator that it was not necessary or relevant for them to rely on his evidence.
Despite the Defendant’s defence to the claim, a negotiated settlement was achieved for the Claimant for £28,000.
