The applicant was sexually abused by her father over a number of years when she was child whilst her mother was complicit in the abuse.

At the age of 13, she disclosed the abuse to a teacher at her school who informed the relevant authorities. As a result, her father was sent to prison for 3 months.

Whilst a police report could not be located, we were able to obtain a certificate of conviction and indictment from the sentencing court to prove the allegations which, otherwise, would likely have resulted in the claim being rejected on the basis that no crime of violence could be determined.

As a direct consequence of the abuse, the client was later diagnosed with Bi-polar and PTSD and had been unable to work since 2001/02.

Medical evidence in support of an award for mental injury and loss of earnings was submitted.
The CICA commissioned a medical report to determine the extent of her injuries and her entitlement to loss of earnings which confirmed both.

In January 2025, she received an award of £306,908.
