Case Study - CICA claim pursued to Appeal

Our client had already made a CICA claim and had been offered £11,000. The claim for a mental injury award and loss of earnings award was rejected. 

The argument over loss of earnings was interesting and unusual. 

Jordans Solicitors appealed the decision and the CICA rejected the claim as the Applicant's friend has written a book about the abuse the Appellant had suffered and named her as the author as recognition of what she had experienced.

The CICA argued that if the Applicant could write a book, then she was not entitled to loss of earnings. 

Jordans Solicitros presented evidence about the author of the book, which the Tribunal accepted. 

The Judge ordered that the Applicant was entitled to a loss of earnings award and the applicant’s case settled in the sum of £176,371.
