When is the right time to make a CICA Claim?

If you've been a victim of a violent crime, you may be eligible for compensation through the Criminal Injuries Compensation Authority (CICA). The CICA scheme outlines clear guidelines for making an application, and timely submission is crucial.

The Importance of Applying Quickly

The CICA recommends that applications be made as soon as reasonably practicable after the incident, and in any case, within two years of the incident date.

For applicants under 18 at the time of the crime:

  • If the incident was reported to the police before the applicant’s 18th birthday, the claim must be submitted by the age of 20.
  • If the incident was reported after the applicant’s 18th birthday, the claim must be made within two years from the date of the first police report.

 

What if there are criminal proceedings ongoing?

There are differing opinions on whether to submit a CICA claim before or after criminal proceedings. Some police authorities advise waiting until after the trial, while others encourage survivors to apply as soon as possible.

Waiting for criminal proceedings to conclude is not a reason to delay your application. The CICA can assess your claim even before the trial has finished and regardless of whether the offender has been found guilty.

It’s important to note that the CICA’s stance is clear: they do not require a conviction before assessing a claim, and the outcome of the trial is not a factor when reviewing your application.

 

Will a CICA Claim Affect the Criminal Trial?

One concern that some survivors may have is whether filing a CICA claim will negatively impact the criminal proceedings. Some police authorities worry that a claim could influence a jury’s perception, possibly implying that the prosecution is financially motivated.

We believe this concern is outdated. In modern trials, judges typically instruct juries to refrain from making any negative assumptions about a victim's credibility simply because they’ve pursued compensation.

While it’s true that cross-examination during the trial may include questions about the claim, answering these questions truthfully should not harm your credibility or undermine the prosecution’s case.

 

The Risks of Delaying Your CICA Application

Delaying your CICA claim can have serious consequences. If you miss the deadline without exceptional circumstances, you may forfeit your opportunity to receive compensation. The longer you wait, the harder it may become to get the support and compensation you deserve.

Don’t wait for the outcome of a trial—apply for CICA compensation as soon as possible to ensure you don’t lose your right to make a claim.
