Further Update on the Assisted Dying Bill – A Timely Reminder to Plan Ahead

Hospital Bed

The Assisted Dying Bill, currently under debate in Parliament, could bring significant changes to the law in England and Wales. If passed, it would allow terminally ill adults, expected to die within six months, to request an assisted death, subject to strict safeguards.

The bill cleared its first stage in the House of Commons and was debated further on 16th May 2025. Key updates to the proposed legislation include:

  • Approval required from two doctors and a multi-disciplinary panel comprising legal, medical, and social care professionals.
  • A four-year implementation period, meaning assisted dying may not become available until 2029.
  • Explicit protections for healthcare and care professionals who choose not to participate in the process.
  • Replacement of High Court oversight with expert panels, alongside the creation of a disability advisory board and independent advocacy support.
  • Government estimates suggest the number of assisted deaths could reach over 4,000 annually, within 10 years of implementation.

MPs were unable to conclude discussions during the recent debate and are expected to resume on 13th June 2025. While the outcome remains uncertain, this evolving conversation highlights how quickly circumstances can change, and the importance of forward planning.

We recommend reviewing the following key areas:

  • Creating a valid will that reflects your wishes and protects your estate and beneficiaries.
  • Putting in place Lasting Powers of Attorney (LPA) for health and welfare, and property and financial affairs, so that trusted individuals can act on your behalf if needed.
  • Document and communicate your end-of-life preferences, helping your family understand and honour your wishes at a difficult time.

Whatever the future holds for this legislation, proactive estate planning remains essential. If you would like to review your will, discuss setting up an LPA, or need advice on end-of-life planning, please get in touch with our Private Client Team today.
