The Travelodge failures that resulted in a woman being sexually assaulted in her hotel room

There has been a lot of recent media attention in relation to the incredible breach of security by a Travelodge employee which led to a woman being sexually assaulted in her own room by another hotel guest. 

The incident occurred at their hotel in Maidenhead in December 2022. Kyran Smith, who was also staying at the hotel, told employees at the hotel that he was the woman’s boyfriend. He had attended the same party as her and had been able to confirm her name to them. They simply handed him a key card to her room. He was able to use the key card to enter the room and sexually assault her. 

It is reported in the media that the hotel offered her £30 in compensation before finally offering the survivor of the abuse an apology. They initially alleged that their employees had “acted in line with their security and safety protocols and within industry standards”. 

After a public outcry and criticism by MP’s the hotel chain has now changed their room key policy so that additional or replacement keys are only issued after permission has been given by the occupant or occupants of the room.  

The customers of a hotel are entitled to expect that they are safe in their hotel room. The simplistic security checks done by the hotel staff were completely inadequate and negligent. They knew or ought to have known that it was a single occupancy room and the fact that the alleged boyfriend was booked into a different hotel room should also have been a red flag.  

In the circumstances the hotel would be liable for the negligence, careless acts and omissions of their staff and the failure of the chain itself to have an adequate system or policy in place relating to key cards.
